As the university shifts to online learning platforms, questions have arisen about the legality of recording class discussions, lectures, conversations and meetings within those platforms. It’s important for all faculty and students to be aware that California’s wiretapping statutes apply to such practices.
Key points to remember are:
- California makes it a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation.
- Faculty should remind students not to record such meetings without express permission from the instructor or meeting leader. Those needing accommodations should contact Disability Services.
- These laws and practices also apply to staff and administration meetings held in digital platforms such as Zoom, Microsoft Teams and others.
